Is it legal for an employer to pull my credit history to qualify me for a promotion?

Pursuant to the Fair Credit Reporting Act, employers must get written permission before they can review an applicant’s credit profile. Employers review your credit profile seeking major negative records such as delinquent and/or derogatory accounts, collections, public records, charge-off's, etc. If an employer decides to take “adverse action” based upon information found in your credit profile, they must notify you first and provide you with a copy of your credit profile. Employers can also review the credit profiles of existing employees, as long as they previously disclosed that they may perform said review. When an employer checks your credit profile it does not negatively affect your credit score.
